M.iii Effective operation of the Paragraph 6 System
198. In agreement with the delegation of India, the representative of Brazil said that there was a pressing need to make the Paragraph 6 System more effective and operational. The system was a milestone in the history of the TRIPS Agreement. It provided a much needed and long awaited response to the difficulties of countries with insufficient or no manufacturing capacities in the pharmaceutical sector. His delegation had played an active role in the negotiations that had led to the adoption of the Doha Declaration on the TRIPS Agreement and Public Health. On 13 November 2008, it had notified its acceptance of the Protocol Amending the TRIPS Agreement. His delegation fully supported the Doha Declaration according to which intellectual property protection could not and should not supersede more fundamental values such as the protection of life and the access of the developing world to life-saving drugs. Three years had been necessary for the first and so far only use of the system which was an unreasonable delay to deal with public health emergencies. This demonstrated that there was room for improvement. He therefore supported the proposal made by the delegation of India that the TRIPS Council examine the system to identify obstacles that were preventing developing countries from making full use of it.
