42. The representative of Brazil reiterated his delegation's position on the relationship between the TRIPS Agreement and the CBD and on the protection of associated traditional knowledge and folklore. He said that document TN/C/W/52 aimed at enhancing the interests of various contracting parties in a balanced way. He said that it was easy to argue that, in the perspective of developing countries, preventing misappropriation of genetic resources was the single most important issue out of the three TRIPS issues. He said that proponents of document TN/C/W/52 considered that an amendment of the TRIPS Agreement to introduce a compulsory requirement of disclosure of the origin of genetic resources in patent applications was the most effective way to prevent misappropriation of biodiversity. He said that the identification of the origin of genetic resources was insufficient, and that it should be complemented by other mechanisms. The discussions currently taking place at the CBD would provide a valuable input for Members' deliberations at the WTO. He shared the main thrust of the intervention made by China and believed it provided Members with some useful and concrete ideas on how to make progress. He said that it was time for Members to engage in text-based negotiations on the three TRIPS-related issues in the Doha Round. In this connection, he expressed his delegation's satisfaction with the Director-General's efforts and hoped that these efforts might lead to a successful outcome. He said that several rounds of consultations had been extremely useful and should be continued. The personal involvement of the Director-General provided evidence of the importance of reaching agreement on the intellectual property issues within the wider context of the Doha Round.
