81. The representative of Japan said that the issue of misappropriation of genetic resources could be considered from two important perspectives: firstly the issue of erroneously granted patents and secondly the issue of compliance with the CBD regarding access to genetic resources and fair and equitable benefit sharing. Appropriate measures should be sought respectively, and in each case they should work towards solutions with no adverse effect on the existing IP system. He said that Japan has proposed the establishment of a one-click database with a view to addressing the issue of erroneously granted patents. 82. He reiterated the importance of the Nagoya Protocol, adopted at the CBD COP10 held in Nagoya, Japan, in October 2010. In accordance with the Protocol, each member was expected to address its domestic implementation, which would in turn have an effect worldwide. 83. With regard to the Bolivian proposal, he reiterated the importance of the patent system as an incentive for technical development in all fields, especially but not limited to biotechnology.
