Ambassador Carmen Luz Guarda (Chile)
G.ii Review of legislation on enforcement
47. The representative of Canada said that her delegation wished to see the best and most effective implementation of all the provisions of the Agreement, including the enforcement Part. However, compilation of the statistical data sought by the United States would create a considerable workload: enforcement was in the hands of courts, the data concerned private rights and the information was widely spread. Her delegation would be happy to provide information about the resolution of any specific cases and would make its best efforts to provide more general data. In any case, experience in Canada had shown that statistics for intellectual property cases often produced very small samples for each separate right, which made it difficult to draw reliable conclusions.
