97. The representative of India, also commenting on the remarks made by the representative of Hong Kong, China, said that there would seem to be a need to examine the legal value of the Singapore Ministerial Declaration vis-à-vis the text of the TRIPS Agreement itself. Regarding the point made by Hong Kong, China that there was no legal basis in the TRIPS Agreement for considering the extension of additional protection for geographical indications to other products, he quoted from Article 24.2, which said that "The Council for TRIPS shall keep under review the application of the provisions of this Section …". As part of the review, it was not conceivable that the Council could come to a conclusion on the basis of consensus.
