The representative of the European Communities said that his delegation had also requested information from the Government of the United States with regard to the application of Section 211, to which the representative of Cuba had referred. He informed the Council that his delegation had bilaterally expressed concern with regard to the Section's possible incompatibility with TRIPS provisions. His delegation was concerned about the retroactive application of the provisions. This concern had been expressed on many occasions but, unfortunately, no response had been received. He stressed that the matter did not concern an academic exercise and that right holders from the EC believed that they would be affected by the provision.
