The representative of Argentina said that the preamble was a fundamental part of the joint proposal in that it contained assurances regarding the principle of territoriality and the balance of rights and obligations in the TRIPS Agreement as well as other elements such as the format of the results of the negotiations, namely a draft decision by the TRIPS Council. With regard to the comment made by the delegation of the European Communities that the preamble would prejudge consideration of the rest of the text, she asked what kind of format that delegation had in mind when it referred, in paragraph 1 of its proposal, to the system "established by this [instrument]".
