The representative of New Zealand recalled that his delegation had asked whether or not it would be correct to assume that the WTO dispute settlement mechanism would not apply to the register if domestic procedures were – as explained by the European Communities – paramount in the proposal. If the WTO dispute settlement mechanism did apply, on what basis could a dispute be brought, assuming that domestic procedures were TRIPS-consistent?
The Special Session took note of the statements made.
