189. The representative of Chile said that those supporting the joint proposal had clearly indicated that the proposal included legal effects, special and differential treatment, and terms on participation. This was not the case with the TN/C/W/52 proponents. His delegation could not accept the position that Members could only discuss the details of a proposal once modalities had been agreed. It was important to know how the proposal would be implemented in all WTO countries. It was important for Members to discuss special and differential treatment. This important issue for all WTO Members could not be left until after possible modalities. For example, France had 800 officials working in its intellectual property office and Brazil 560 officials according to its website. This was not the case in Chile, nor in the majority of Members. It was important that developing countries supporting the joint proposal, and those supporting the TN/C/W/52 proposal, clearly understand the effects of paragraphs 1-3 in TN/C/W/52.
The Special Session took note of the statements made.
