C.3.c Purpose
131. The representative of Australia, taking the example of "Tokay", said that immediately after the register was opened Australia and Hungary would both be racing to get in the first notification of "Tokay". If Hungary registered that name first, Australia would object to that. However, if other Members where Australian "Tokay" was distributed did not challenge the notification by Hungary, they would have to accept the notification of Hungary's "Tokay". In his view, the question of a Member losing its rights in third markets was a serious one.
