C PARAGRAPH 6 OF THE DOHA DECLARATION ON THE TRIPS AGREEMENT AND PUBLIC HEALTH
42. The representative of Brazil referred to the resolution that had been adopted in the WHO on intellectual property rights, innovation and public health. The draft resolution was tabled by many developing countries, including Brazil, the African Group and many countries from Asia and Latin America. The resolution urged member states to reaffirm that public health interests were paramount in both pharmaceuticals and health policies. It further urged member states to adopt national legislation that used, to the fullest, the flexibilities contained in the TRIPS Agreement and also to continue their efforts to reaching a consensus on the paragraph 6 issue. He said that the adoption by consensus of this resolution in the WHO was a signal to the TRIPS Council of the great importance attached by the international community to the relation between intellectual property and public health. He noted that it was a display by the international community of a willingness to deal with public health problems faced by developing countries. He added that his delegation fully shared the feelings of frustration expressed by other Members regarding the lack of progress in discussions on the establishment of a permanent and multilateral solution to the problems identified by paragraph 6 despite their active and constructive participation. He reaffirmed the great importance attached by his delegation to the search for a permanent, multilateral solution to the problem identified by paragraph 6.
