Mr. Martin Glass (Hong Kong, China)
Chinese Taipei
C; D; E REVIEW OF THE PROVISIONS OF ARTICLE 27.3(b); RELATIONSHIP BETWEEN THE TRIPS AGREEMENT AND THE CONVENTION ON BIOLOGICAL DIVERSITY; PROTECTION OF TRADITIONAL KNOWLEDGE AND FOLKLORE
100. The representative of Chinese Taipei said that her delegation had not yet decided its position on the TRIPS/CBD issue, although it had raised some important technical questions at the previous meetings, such as the definition of traditional knowledge and the trigger of disclosure requirements. In the absence of satisfactory answers to these questions, she hoped that the ongoing Director General consultations would provide clarities and that the Director General could increase frequency on holding open ended consultations. She said that her delegation did not support the parallelism as each issue should be discussed on its own merits. Given the complexity of the TRIPS/CBD issue, her delegation had not come to a conclusion on the necessity of amending the TRIPS Agreement.
