The Polish Government hereby wishes to inform the Council for Trade-Related Aspects of Intellectual Property Rights on the following reservations, in accordance with paragraph 3 of Article 1 of the Agreement on Trade-Related Aspects of Intellectual Property Rights. Poland will not apply the criterion of publication provided for in paragraph 1(c) of Article 5 of the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done on 26 October 1961 (the Rome Convention). In accordance with the provisions of Article 6(2) of the Rome Convention as incorporated into the TRIPS Agreement through Article 1.3, Poland wishes also to notify that it will protect broadcasts only if the headquarters of the broadcasting organization is situated in another WTO Member and the broadcast was transmitted from a transmitter situated in the same WTO Member.
