6. Brief description
Türkiye has reformed its industrial property rules, namely patents (inventions), industrial designs, trademarks, geographical indications, by this new Law No. 6769 of 2016 (Industrial Property Code) replacing a series of individual laws, executive decrees, and regulations. This law covers all matters related to trademarks, geographical indications, designs, patents, utility models, and traditional product names. It also encompasses applications, registrations, and post-registration processes including legal transactions (license, transfer, pledge, inheritance, etc.) and criminal sanctions concerning the violation of these rights and brought a number of substantial changes in the Turkish intellectual property system, including updates in administrative structure and capacity of TÜRKPATENT, which changed its previous title (Turkish Patent Institute) to the new “Turkish Patent and Trademark Office”.

ARTICLE 192- (1) This Code’s; a) Article 26 shall enter into force after seven years from the date of publication, b) The provisions regarding the period of making renewal requests regulated with the second paragraph of Article 23 and fourth paragraph of Article 69 and the provisions related to the obligation of using emblem regulated with Article 46 shall enter into force after one year from the date of publication, c) Other provisions shall enter into force on the date of publication.
