C.i Paragraph 6 of the Doha Declaration on the TRIPS Agreement and Public Health
63. The Chairperson recalled that paragraph 6 of the Declaration on TRIPS and Public Health (WT/MIN(01)/DEC/2)(referred to as the " Declaration" under this agenda item) recognized that WTO Members with insufficient or no manufacturing capacities in the pharmaceutical sector could face difficulties in making effective use of compulsory licensing under the TRIPS Agreement. The Ministerial Conference had instructed the Council to find an expeditious solution to the problem and to report to the General Council before the end of 2002. He proposed that the Council plan to be in a position to make concrete recommendations to the General Council about how this matter should be dealt with by the end of 2002. Since the matter was clearly complex and there might well be some differences of approach and view among delegations, the Council needed to leave adequate time to work through these differences. It was therefore important that the various proposals that delegations might have be tabled in good time. He suggested that the Council consider requesting those Members who had concrete proposals to submit them by the June meeting of the Council on the understanding that this would not be a rigid deadline.
