The Federal Republic of Germany, in accordance with Article 1, paragraph 3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, confirms that it will not apply the criterion of fixation referred to in Article 5, paragraph 1(b) of the Rome Convention as regards the protection of producers of phonograms
