I have the honour to notify the Council on Trade-Related Aspects of Intellectual Property Rights, in accordance with Article 1.3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, that in applying the provisions of the Rome Convention and in respect of Article 5(1)(b) thereof and in accordance with Article 5(3) thereof, the Government of the United Kingdom of Great Britain and Northern Ireland will not apply, in respect of phonograms, the criterion of fixation.
