The retroactive protection according to Article 18 of the Berne Convention is provided by Article 6 of Law No. 8594 dated 6 April 2000, which replaces Article 51 of the previous law and stipulates that:
"the provisions of this law shall apply to works created before the moment this law came into force but have not yet fallen into the public domain through the expiry of the term of protection afforded under this law".
