6. Article 9(1) of the TRIPS Agreement in conjunction with Article 14 of the Berne Convention (1971) requires that authors of literary or artistic works shall have the exclusive right of authorizing the cinematographic adaptation and reproduction of these works and the distribution of the works so adapted. Section 3(1)(e) of the Copyright Act gives authors the right to "reproduce, adapt and publicly present the work by cinematography". Is the right to "publicly present" in the Copyright Act synonymous with the right to "distribute" in the Convention?
Under Section 3 of the Canadian Copyright Act, the right to publish a work together with the right to publicly present a work by cinematography together fulfil the obligations of TRIPS, Article 9(1), and Berne Convention, Article 14.
