The representative of the United States said that, according to the EC paper (document IP/C/W/107/Rev.1, paragraph D.4), the exceptions would no longer be available to Members after 18 months, which was currently not the case under the Agreement. He asked for clarification: if a Member did not prevail in the opposition procedure or failed to oppose, would that Member be able to avail itself of the exceptions under Article 24?
