J.ii Revocation of patents
75. The representative of India; supported by the representatives of Brazil and Paraguay; requested the delegation of the United States to provide its proposal in writing; so that others would have the opportunity to reflect upon it and react in due course. By way of preliminary reaction; she said that the Section on patents in the TRIPS Agreement contained a separate Article on revocation/forfeiture; i.e. Article 32; which only required Members to provide for judicial review of decisions on revocation or forfeiture. Article 27 laid down that patents "shall be available" and not that patents must be granted; as stated by the United States.
