E IMPLEMENTATION OF ARTICLE 66.2
42. The representative of the Philippines said that, in the view of his delegation, the implementation of Article 70.8 and 70.9 should not necessarily be monitored in the same way as the implementation of Article 66.2. Obligations under Article 70.8 and 70.9 applied to a small group of Members, namely only those yet to provide for product patent protection of pharmaceutical and agricultural chemical inventions. Monitoring the implementation of these obligations, which in practice only concerned developing and least developed countries, did not require a systematic review, but could be left to interested Members posing questions to the Members concerned on the floor of the Council, as they deemed appropriate. However, Article 66.2 imposed an obligation on all developed country Members, which made a systematic review the more appropriate way of monitoring.
