K REVIEW OF THE PROVISIONS OF ARTICLE 27.3(b)
114. The Chairperson said that, apart from the circulation as a TRIPS Council document of the background note that the Secretariat had prepared for the Committee on Trade and Environment on the relationship between the Convention on Biological Diversity and the TRIPS Agreement, he had no new papers to draw to the TRIPS Council's attention on this subject. He further informed the Council that he had held consultations on how the work might proceed, pursuant to the decision taken by the TRIPS Council at its last meeting. In these consultations, he had sought advice from Members on the best approach for carrying forward the work on the basis of a discussion on the four options that had been put forward at the last TRIPS Council meeting. These options were: to conclude the review; to continue the open-ended discussion; to have a more structured discussion; to assemble a fuller information base which would take better account of the way in which Article 27.3(b) had been implemented by transition economy and developing country Members. He was not as yet in a position to report any concrete outcome of the discussions that had taken place and suggested that he might continue his informal consultations on the matter.
