Regulation on the Registration of the Intellectual and Artistic Works
Rights on Intellectual and Artistic Works are not subject to the registration requirement and such rights exist from the moment when the work is created. However, “registration system” is implemented in order to provide evidential proof of the right holder and follow up the authority to exercise the financial rights without aiming at creating rights. Film producers that make the first fixation of films and phonogram producers that make the first fixation of sounds shall have their productions containing cinematographic and musical works recorded and registered for the purpose of preventing violation of their rights, facilitating proof of rightholdership and tracking the authority to exercise economic rights, and without the aim of creating any rights. The recording and registration of all the works protected under Law No 5846 on Intellectual and Artistic Works may be made for the same purpose upon demand of the authors; the authority to exercise economic rights may also be recorded. In order to improve the smooth functioning of the Regulation and to meet some needs notified to the Directorate General of Copyright rising from practices of the regulation in the field, some amendments were made to facilitate the practice and enforcement.
Regulation entered into force on 17/5/2006. Recent amendments dated 6/7/2021 entered into force on 1/1/2022.
