Ambassador C. Trevor Clarke (Barbados)
Hong Kong, Chine
B.i Cluster 1 (consequences/legal effects of registrations and participation)
168. The representative of Hong Kong, China said, in response to Canada's question on the implementation of her delegation's own proposal, that she could not say how other Members might implement the proposal as, according to Article 1.1 of the TRIPS Agreement, Members were free to determine the appropriate method of implementing the provisions of the TRIPS Agreement within their own legal system and practice. Hong Kong, China would implement the proposed GI register according to its own legal system and practice, and did not foresee any difficulty in implementing it in its jurisdiction. Provisions might have to be introduced in the domestic legislation to give legal effects to the GI register or to provide for the admission of the certificate of registration as prima facie evidence. Her delegation would be pleased to enter into bilateral dialogue with interested Members that had concerns about or interest in the implementation of Hong Kong China's proposal in its own jurisdiction.
